Terms and Conditions

Terms of Service for "Annual Cosmetic School BeautyExpert Online"
The Terms of Service set forth the rules for using the "Annual Cosmetic School BeautyExpert Online" website available at www.beautyexpert.io. Using this website means accepting these Terms of Service. If you do not accept them, please leave www.beautyexpert.io.

§1. DEFINITIONS
For the purposes of these Terms, the following definitions are used:

·        Administrator/Seller – A company named ESSENT Sp. z o.o., headquartered at Mieczykowa 18A, 65-012 Zielona Góra, KRS: 0000979856, NIP: 9292071921, REGON: 522454636, email: online@beautyexpert.io; phone number: 885-766-333.

·        Terms – These Terms of Service, available at https://www.beautyexpert.io/terms-of-service.

·        Website – The "Annual Cosmetic School BeautyExpert Online" website located at www.beautyexpert.io, where the Seller provides services to customers, including educational materials—graphics, text, audio, and video—related to cosmetology.

·        Guest – A natural person, legal entity, or an organizational unit without legal personality, using the Website either without a registered Account or without being logged in, having access to general information, Privacy Policy, and Terms as well as: • "HOME PAGE" panel – containing general information about the Service provided by the Seller, • "FAQ" panel – containing frequently asked questions and answers prepared by the Seller, • "CONTACT" panel – containing Seller’s details and contact form, • "ABOUT US" panel – containing information about the Seller's company and trainings, • "PROGRAM" panel – containing a list and description of Online Lessons that make up the Training, • "PRICE LIST" panel – containing information about the pricing of the Service.

·        Customer, Participant – A person who has successfully filled out the Registration Form on the Website and purchased access to the Service under a selected Payment Plan, thereby gaining access credentials and access to the Platform. Customers can be natural persons, legal entities, or organizational units without legal personality granted legal capacity by law.

·        Consumer – A natural person using the Website for purposes not directly related to their business or professional activity.

·        Service, Access to the Service, Training – The service provided by the Seller electronically within the Website, allowing access to educational materials in graphic, text, audio, and video forms related to cosmetology, access to which is possible from the Platform as described in the Terms.

·        Account, Platform, Access to Platform – The Website functionality containing information about: • Training materials available or yet to be purchased by the Customer, • Previous payments made by the Customer, • Available Payment Plans, with pricing, • Personal data filled out during Registration.

·        Access Credentials – Customer's email address (Login) and password set in the Registration Form, enabling access to the Platform after a successful payment for Platform Access. Access credentials can be changed by the Customer in the Platform.

·        Payment Plan – Divided into Recurring Payment and One-Time Payment. Recurring Payment is the Customer's obligation to pay the Seller PLN 370 monthly for using the Service – a payment of PLN 370 allows access to 4 (four) Online Lessons. Choosing the One-Time Payment option requires the Customer to pay the entire fee upfront for all Lessons available on the Platform – the purchase price is then PLN 3,552.00 and includes a discount compared to the price for the Service when choosing the Recurring Payment. Selecting a specific Payment Plan and making the payment is required to gain Access to the Service.

·        Minimum Fee – A PLN 370 fee resulting from the choice of the Recurring Payment plan, which allows access to 4 (four) Online Lessons, is non-refundable in the event of withdrawal from the contract as described in §9 of the Regulations. It is the remuneration due to the Seller for the provision of the Service for the first Billing Period.

·        Billing Period – A monthly period in which the Customer is provided with Online Lessons as part of the Recurring Payment plan, starting from the day of making the monthly payment arising from this plan until the day preceding the day on which the Customer is obliged to make the next monthly payment within the framework of the Recurring Payment.

·        Online Lesson – A unit into which the Training provided by the Seller on the Platform is divided. The Service provided by the Seller consists of 44 (forty-four) Lessons – each of them includes training material from a specific area of cosmetology in both theoretical and practical dimensions. The Lesson is made available to the Customer every 7 days from the time of purchasing a specific Lesson. The next Lesson, marked with a subsequent number, is made available immediately after the expiry of this period if it falls within the scope of the purchased package. When choosing the Recurring Payment, the Customer gains access to 4 Lessons for a period of 30 days starting from the payment of the first fee. After this period has expired, access to the next Lesson is conditioned by the proper payment of the next monthly fee provided for in the Recurring Payment plan. Subject to the rules described above regarding the provision of each of the individual Online Lessons, when choosing the One-Time Payment, the Customer gains access to each of the offered Online Lessons on the Website for the Training Period.

·        Training Period – 12 (twelve)-month duration of the Training, which begins from the time of making the first payment by the Customer and providing the Customer with the first Online Lesson.

·        Account Subscription – A feature of the Service available to the Customer who has completed the Training and wants to retain access to the training materials after the Training Period has expired. Using this feature is possible from the "Payment Plan" by selecting the appropriate Payment Plan. Two options are then available: Monthly Payment of PLN 39 for a month of account subscription and Annual Payment of PLN 249 for a year of account subscription. During the active Account Subscription, the Customer has unlimited access to the training material purchased during the Training Period.

·        Certificate – An electronic document in .pdf format confirming from the Seller's side that the Customer has completed a given Lesson, which the Certificate pertains to. The possibility of downloading the Certificate from the Platform is conditioned by the Customer obtaining 100% correct answers from the Quiz available in a given Lesson and paying the fee for its issuance.

·        Diploma – An electronic document in .pdf format confirming from the Seller's side that the Customer has passed the Final Exam, and thus successfully completed the Training.

·        Quiz – A test consisting of 5 (five) questions checking the Participant's knowledge of the scope of the Lesson, which the Quiz pertains to. Only providing 100% correct answers allows the Participant to purchase a Certificate attesting to the acquisition of knowledge in the subject matter covered by the Lesson to which a given Quiz pertains. The Quiz is available in each of the Lessons posted on the Platform.

·        Mock Exam – One of the Quizzes, which the Participant can take at any stage of the Service provided by the Seller, at any time (as practice) until the Subscription Option is canceled, payment is stopped within the framework of the Recurring Payment plan, or the contract is terminated. The Participant does not have to take the Mock Exam to take the Final Exam.

·        Final Exam – The last of the Quizzes, which the Participant may take if they have familiarized themselves with the training material available in each of the 44 (forty-four) Online Lessons (have been made available to them) and have passed all the Quizzes, except for the optional Mock Exam, by giving 100% correct answers in each of them.

·        Registration Form – A questionnaire that the Customer fills out during Account registration in order to gain Access to the Service. The form is available at https://www.beautyexpert.io/registration directly related to the activity of the Service.

·        Password – A string of characters defined by the Customer during the Account registration process.

·        Username (Login) – Email address defined by the Customer during the Account registration process.

·        Login – Confirmation of the identity of the registered Customer by entering the Login and Password.

·        Payment Operator – PayU S.A., ul. Grunwaldzka 186, 60-166 Poznań, NIP: 7792308495.

·        Contact Form – A form available on the Service at the address: https://www.beautyexpert.io/contact, enabling sending a message to the Seller's email box.

§2. PRELIMINARY PROVISIONS

The service of access to paid content (in the form of graphic, text, audio, and video materials available on the Website) is provided by the Seller. The paid services provided by the Seller are divided into providing Access to the Platform and providing training material in the form of online lessons for a fee paid by the Customer (Access to the Service).
The Service is provided on the Website under the terms specified in these Regulations.
3.     This Regulation defines the general rules constituting the legal basis for using the services on the Website. Each Client is obliged, from the moment of undertaking actions aimed at using the services, to comply with the provisions of this Regulation.

4.     Before using the services, the Regulation below should be read carefully. By starting to use the services, the Client confirms that they have read the content of the Regulation, accepts its provisions, and undertakes to comply with them.

5.     Using the service does not require specialized equipment or software. The Client acknowledges that to make a purchase and use the services provided by the Seller through the Website, it is necessary to meet, among others, the basic technical conditions for the computer or other device they are using, such as:

An Internet browser supporting HTML, CSS, JavaScript standards
Enabled JavaScript support
Enabled Cookies support
Internet access
A common operating system
Ability to play video files
Having an active email address
6.     Due to factors independent of the Seller related to the Internet and computer hardware, the Seller does not guarantee uninterrupted and undisturbed access to the Website. The Seller is not responsible for any interruptions in the Service or disturbances in its reception caused by network properties or equipment used by the Client.

7.     Video materials available within the Service have a Polish language version. The quality of the played video materials may depend on the technical parameters of the Internet connection and the technical parameters of the device on which the video materials are played.

8.     The Client cannot make a purchase anonymously or under a pseudonym. The Client is prohibited from performing actions prohibited by applicable laws, especially violating the rights of third parties, for example, by using other Clients' accounts without proper authorization, or attempting to obtain the Logins and Passwords of other Participants.

9.     It is forbidden for the Client to provide unlawful content, especially by sending such content within the Registration Form and Contact Form available on the Website. It is forbidden for Clients to share content available on the Website and Access Data with third parties, under penalty of losing Access to the Platform.

10.  Each time a specific purchase of services on the Website will require the Client to make a declaration of consent to the loss of the right to withdraw from the contract, if the Client selects this option and makes the purchase, the Client will also receive a notification to their email address specified in the Registration Form confirming the submission of this declaration.

§3. COPYRIGHT

1.     The Seller declares that the training materials posted on the Website are works within the meaning of the Act of February 4, 1994, on copyright and related rights (consolidated text: Journal of Laws of 2022, item 2509), to which copyright belongs exclusively to the Seller.

2.     By acquiring access to the works, whose distribution is not through the provision of a physical copy of the work but by enabling access to it through the Platform, the Client acquires the right to reproduce the work exclusively for their personal use. In particular, the Client does not have the right to publicly play the work, copy it in whole or in part, multiply, further transfer, modify, use as part of other works, distribute among third parties.

3.     The Seller declares that, for the purpose of providing service activities, he may use other publicly disseminated works within the prepared materials for the Service for educational and scientific purposes.

4.     Violation of the provisions of this paragraph may constitute a basis for civil and criminal liability, as specified in the Act of February 4, 1994, on copyright and related rights (consolidated text: Journal of Laws of 2022, item 2509).

§4. ACCESS TO THE PLATFORM

1.     Access to the Platform is possible for the Client in the following way: The Client follows the instructions on the page available at https://www.beautyexpert.io after clicking on the "CREATE ACCOUNT" banner in the "MY ACCOUNT" panel located in the upper right corner of the Website. Then, the Client is redirected to the page https://www.beautyexpert.io/registration where they fill out the Registration Form, indicating personal data, their email address (Login), and setting their own Password, and selecting the appropriate Payment Plan. Then, after clicking the "CREATE ACCOUNT" button, they are transferred to the Payment Operator's page to make payment for the Service using the methods available there, in the dimension corresponding to the selected Payment Plan.

2.     Making a Minimum Payment is required for registering an Account and gaining Access to the Platform. Upon making the payment, the Client also receives Access to the Service within the scope resulting from the selected Payment Plan. Registration in the manner specified in this paragraph requires accepting declarations concerning the processing of personal data and consent to the immediate implementation of the Service causing the loss of the right to withdraw from the contract concluded with the Seller, which is necessary for making a purchase in accordance with the selected Payment Plan and gaining access to the Platform.

3.     Access to the Platform, upon recording the first payment, is granted indefinitely. Thus, Access to the Platform is conditional upon the prior completion of the Registration Form by the Guest and making at least the Minimum Payment corresponding to the monthly fee for the Service in Recurring Payments. From that moment, the contract for the provision of digital content is considered concluded between the Client and the Seller for an indefinite period. The Client may at any time contact the Seller to terminate the contract for Access to the Platform by sending an email to online@beautyexpert.io or by sending a letter in this regard to the Seller's headquarters.

§5. ACCESS TO THE SERVICE

After making a payment in the amount resulting from the selected Payment Plan, the Client gains Access to the Service by receiving access to the first part of the training material prepared by the Seller. The first part of the training material consists of Online Lessons made available to the Client sequentially, week by week, during the Billing Period. Therefore, each Online Lesson is made available to the Client every 1 (one) week, for the entire Training Period, starting from the first Online Lesson – made available on the day the first payment is made. A minimum Fee is required to gain Access to the Platform and the Service. Failure to select the appropriate Payment Plan and make the payment prevents Account registration and, consequently, gaining access to the Platform and using the Service.
The Client, by choosing Recurring Payments, pays a training fee of 370.00 PLN (three hundred seventy zlotys) on a monthly basis, which corresponds to Account registration by the Seller (in the case of the first payment) and the provision of Online Lessons launched weekly during the Billing Period. To continue to access subsequent Online Lessons and make progress in the Training, the Client must make another monthly payment resulting from the selected Recurring Payment Plan. The Seller will notify the Client of the upcoming payment 5 days before the payment deadline (30 days from the day of making the previous payment). The Seller will include a link in the email, allowing the Client to be redirected to the Payment Operator's website to make the payment. Furthermore, information about the next payment date will be visible in the Account.
The Client, by choosing a One-time Payment, pays a one-time training fee of 3,552.00 PLN (three thousand five hundred fifty-two zlotys), which corresponds to the Account registration by the Seller (in case of the first payment) and access to 44 Online Lessons made available weekly for the entire Training Period starting from the day of making the One-time Payment. The price for the service in this Payment Plan includes a 20% discount compared to the price that the Client would have to pay when choosing Recurring Payments.
For the second and subsequent payments, the Client can also purchase the Service directly from their Account. In the “PAYMENT PLAN” panel, after accepting the legally required consents, i.e., agreeing to the Terms of Service, personal data processing, and immediate Service implementation resulting in the loss of the right to withdraw from the contract, the Client clicks on the “ACTIVATE PLAN” button and is redirected to the Payment Operator's site to pay for the Service according to the selected Payment Plan.
The Seller may refuse to register an Account and provide the Service or block the Client's Access to the Platform in cases of:
Incorrect completion of the registration form by the Client,
Providing false information by the Client,
Violation of the Seller's or third parties' rights by the Client,
Breach of any provision of these Terms by the Client,
When the Client owes the Seller under any title, and the debt is due and has not been settled,
When the Client uses the Service to commit an offense or crime, or their actions violate social norms or constitute abuse of law,
Any interference with the functioning of the Service by the Client without prior written consent from the Seller,
When the Client shares their Login and Password with third parties.
§6. PAYMENTS

When purchasing Access to the Platform and the Service, the Client may choose the following payment methods: bank transfer, BLIK, or payment card transaction. Additionally, the Client may choose deferred payment methods offered by Twisto Polska Sp. z o.o. and PayPo Sp. z o.o., as well as credit offers from the Payment Operator and collaborating institutions. The Seller is not responsible for the proper conduct of the payment procedure on the Payment Operator's site and has no influence on the actions taken by the Payment Operator and entities cooperating with it. By making payments on the Service, the Client agrees to the terms of use of the sites administered by the Payment Operator and cooperating institutions.
After successfully making the payment, the Client will be redirected to the Service page with purchase confirmation. From that moment, the contract for the provision of digital content in the form of the Service is considered concluded between the Client and the Seller, depending on the selected Payment Plan, and therefore the relevant scope of training material provided by the Seller. The Seller will confirm the conclusion of the contract by sending a purchase confirmation and a PDF invoice to the Client's email address (Login) provided in the registration form.
If the payment could not be processed for any reason, including technical issues, the Seller will inform the Client of the temporary inability to activate Access to the Platform or the Service and the time within which the issue will be resolved. The Client cannot claim compensation or other benefits to compensate for the temporary lack of access to the services provided by the Seller.
All prices for services provided by the Seller on the Service are gross prices, i.e., including the applicable VAT.
§7. ACCOUNT AND SERVICE ACCESS AND USAGE

Access to the Platform is provided to the Client through Account registration, which they can log into using their Access Data. Registering an Account and logging in for the first time using the Access Data confirms the beginning of the contract implementation by the Seller and the Client, as understood by the Act of July 18, 2002, on providing services by electronic means (Journal of Laws of 2020, item 344), for an indefinite period.
Access to the Service is made available to the Customer through the Platform for a designated period of 30 days when making a monthly payment under the Recurring Payment scheme, and for 12 months when making a payment under the One-Time Payment plan, starting from the time of payment. During this time, the Customer can review training materials available on their Account. In case of choosing the Recurring Payment, the Customer agrees to pay monthly, consecutive fees for each part of the Training that remains active during the Training Period, provided the Customer makes payments regularly, according to §5, clause 2 of the Regulations. In any case, the online Lesson is available for the Customer until the end of the Training Period, provided they regularly fulfill or have fulfilled the payment obligations from the chosen payment plan. After the Training Period expires, the training material is no longer available for the Customer, unless they use the Account Subscription Option, mentioned in clause 6.
If the Customer decides to cancel further monthly payments in Recurring Payment, they agree to lose access to the existing part of the training material available on the Account, thus losing the progress in the Training. Canceling further payments in Recurring Payment is available from the Customer Account panel in the "Payment Plan" section. In the bottom-right corner, there's a green "Cancel Future Payments" option. This is the only place where you can cancel further payments. Canceling further payments in Recurring Payment means:
Loss of access to Online Lessons previously available on the Account.
Resetting scores of Quizzes taken so far in Online Lessons on the Account.
Loss of the ability to purchase additional Certificates.
The need to restart the entire Training and thereby repurchasing the Service starting with the first Online Lesson in sequence.
4.     After the Training Period expires, or after choosing the option to Cancel further payments in the Recurring Payment as mentioned in clause 3, the Customer loses access to all previously purchased training materials. They will only have the option to download a diploma (for participants who passed the Final Exam), download a certificate (purchased during active access to a specific Lesson and passed the Quiz 100%), and access information about the transaction history within the Account.

5.     If the Customer chooses not to cancel further payments in the Recurring Payment scheme but fails to pay the due monthly fees, their continued participation in the ongoing Training will depend on the purchase of overdue Online Lessons that could have been available to them, had they chosen to make successive payments and permanently unlock further training materials. In this case, purchasing overdue Online Lessons does not extend the duration of the Training, which expires 12 months from the first payment made by the Customer.

6.     Account Subscription allows the Customer to continuously and unlimitedly review training materials purchased during the Training Period from the Account. The maximum subscription period is 12 months from the time of its activation from the "Payment Plan" by the Customer who has completed the Training and passed the Final Exam. After this period, the Subscription can be renewed. The conclusion of the agreement between the Customer and the Seller for the supply of digital content occurs upon the selection of a specific Payment Plan and making a monthly or annual payment. Payment for the Account Subscription also requires accepting statements concerning the processing of personal data and consent for immediate provision of the Service, causing the loss of the right to withdraw from the agreement concluded with the Seller.

7.     The Customer is obliged to keep their Access Data confidential and protect them from third-party access. The Seller is not responsible for the use of the Customer's access data by an unauthorized person due to improper security of this data.

8.     Each use of the Service requires an Internet connection. The cost of the Internet connection to the Service is determined by the service providers used by the Customer. The Seller does not charge fees for this purpose.

9.     The current cost of paid Access to the Platform or Service is specified on the Website. The Seller reserves the right to change the prices of paid services offered on the Website, to conduct temporary promotional and discount campaigns, including making changes to them. Changes do not apply retroactively and do not entitle the Customer to a refund for a Service paid in the past.

10.  Within a single Access to the Service, it is possible to play training material covered by this Access on multiple devices simultaneously.

11.  The Seller can independently reset the password using the "I forgot my password" option available on the login screen in the bottom-left corner of the form available on the website https://www.beautyexpert.io/login – then a new password is generated by the Seller and sent in an email to the address specified during the purchase of Access to the Platform and the Service. Password change can also occur after prior contact with the Seller by email.

12.  The Seller can irreversibly block the Customer's Access to the Platform, and thereby to all Services on the Website, immediately in cases:

of violation of any provision of these Regulations;
in the event of termination of operations or the operation of the Service, of which the Seller will notify the Customer in advance.
The Seller reserves the right to modify training materials and terms of use of the Service, provided that the part of the training material purchased by the Customer will operate according to the rules described in the Regulations and the information contained on the Website, in force at the time the Customer gained Access to the Service.
§8. QUIZ AND CERTIFICATES

1.     After reviewing the training material contained in each of the online Lessons provided to the Client, they have the opportunity to test their knowledge by taking a Quiz. The correctness of the selected answers can be verified by clicking on the "CHECK ANSWERS" banner. The Quiz can be taken an unlimited number of times throughout the Client's active access to the Lesson, during the Training Period. The highest score achieved by the Client is visible in the "ONLINE LESSONS" panel at the top of the tile for each online Lesson in which the Client has chosen to take the Quiz.

2.     Achieving 100% correct answers from the Quiz available in a given online Lesson allows for the purchase of a certificate confirming the completion of training on the subject matter covered in that Lesson. The fee for generating a Certificate for the Client is 69 PLN. Certificates can be purchased at https://www.beautyexpert.io/online-lessons/certificates, as well as by using the "Buy Certificate" button available in the menu on the left side of each online Lesson or the "Download Certificate" button available under the list of Online Lessons. Once payment for this service is recorded, the Seller enables the Client to download a personalized Certificate from their Account in the System.

3.     Canceling a payment during the Recurring Payment process or after the Training Period has expired does not result in the loss of access to previously purchased Certificates. However, the Client then loses the ability to purchase new Certificates related to other online Lessons they have purchased but have not chosen to buy a Certificate for.

4.     Certificates are issued individually, and it is only possible to obtain a Certificate for one person per Account. Any change of data for the person to whom the Account has been assigned is only possible after prior contact with the Seller and with their consent.

§9. PRACTICE EXAM, FINAL EXAM, AND DIPLOMA
1.     Throughout the active access period to the Service, the Client has the opportunity to test their knowledge by taking a Practice Exam, which serves as a simulation of the Final Exam. The only requirement that the Client needs to meet is the payment due under the chosen Payment Plan. An attempt at the Practice Exam does not require obtaining 100% correct answers from the Quizzes related to specific online Lessons.

2.     Upon completion of the Training Period, and after properly familiarizing oneself with the training material available in each of the 44 online Lessons, the Client has the opportunity to take the Final Exam.

3.     The Final Exam consists of 20 multiple-choice questions and is an extended version of the Quiz. Achieving a minimum of 80% correct answers from the Final Exam enables the download of a Diploma confirming the completion of the entire Training available on the Website.

4.     Canceling further payments during the Recurring Payment process or after the expiration of the Training Period does not result in the loss of access to a Diploma generated by the Service.

5.     It is also possible to attempt the Final Exam after the previously specified deadline and without the need to use a Subscription Account. The first two attempts at the Final Exam are free for the Client. The condition for the first and second attempts at the Final Exam is solely the purchase of access to all training material available on the Website (44 online Lessons) and the expiry of the Training Period.

6.     The third and each subsequent attempt at the Final Exam is possible for an additional fee of 59 PLN paid by the Client from their Account. The exam attempt remains available in the "Online Lessons" section under the "Final Exam." Only the behavior of the "Take the Exam" button changes. On the third attempt, a message will appear stating that payment is required, and the Client will be asked to confirm this. Only after settling the payment will it be possible to retake the Final Exam. From the moment the Client makes the payment, a contract is concluded whose aim is to immediately provide the Client with the opportunity to retake the Final Exam. This process also requires the Client to accept statements regarding the processing of personal data and consent to the immediate provision of the Service, resulting in the loss of the right to withdraw from the contract concluded with the Seller.

7.     After obtaining a positive result from the Final Exam, the Client has the opportunity to download a personalized Diploma generated by the Platform at no additional cost. The diploma confirms that the Client has successfully completed the Training.

§10. WITHDRAWAL FROM THE CONTRACT
1.     The provisions of this paragraph apply only to Consumers. In addition, these provisions apply to a natural person concluding a contract directly related to their business activity, when it does not have a professional character for that person, arising in particular from the subject of the activity performed by them, made available on the basis of regulations on the Central Register and Information on Economic Activity.

2.     The Client who has entered into a contract with the Seller that includes Access to the Platform has the right to withdraw from this contract without giving any reason within 14 days from the date of conclusion of the contract. Such withdrawal will result in the loss of access to the Account at the end of the first Settlement Period.

3.     Withdrawal from the contract by the Client results in the loss of the possibility of obtaining a refund of the Minimum Fee. The Client loses this right in connection with the expressed consent for the immediate activation of Access to the Service marked in the Registration Form, then confirmed in an e-mail sent to the Client's mailbox. The loss of the right to recover the full fee paid results from the immediate fulfillment of the obligation by the Seller in the scope covering the first Settlement Period, for which the Client has given consent by checking the appropriate box in the Registration Form. Despite the withdrawal, the Client still has the opportunity to review the training materials made available on the Website until the end of the first Settlement Period, after which they will lose access to the Account, in accordance with para. 2.

4.     The Client who opted for a One-Time Payment to gain Access to the Service and then properly withdrew from the contract will receive a partial refund of the fee paid, in the amount constituting the difference between the paid service and the Minimum Fee charged by the Seller in connection with the immediate provision of the Service. Thus, in the event of withdrawal from the contract on the terms described in this paragraph, regardless of the chosen Payment Plan, the Seller does not refund the Minimum Fee to the Client, which is 370 PLN, corresponding to the service provided in the first Settlement Period. The Client is not entitled to a proportional refund of part of the fee from the One-Time Payment that includes a discount granted at the time of purchase of Access to the Service, as referred to in para. 1 above. The Seller may withhold a refund until they have received the Client's statement on withdrawal from the contract.

5.     To withdraw from the contract, the Client must inform the Seller of their decision in the form of an unambiguous statement - either as traditional mail sent to the registered office address of ESSENT Sp. z o.o., or as an email sent to the online@beautyexpert.io mailbox, indicating the subject as "WITHDRAWAL FROM CONTRACT."

6.     To comply with the withdrawal period, the Client must send information about exercising their right to withdraw from the contract before the expiration of the 14-day period from the day of receiving the Access Data.

7.     In the case of withdrawal from the contract, the Seller will disable the Client's further use of the Platform by blocking access to the Account after the first Billing Period. The Seller will then cease using the Client's data that were not provided during the time of access to the Platform.

§11. COMPLAINTS

1.     The Client has the right to file a complaint regarding issues related to the functioning of the Service, as well as in the scope of processing their personal data.

2.     Complaints concerning payment transactions handled by the Payment Operator must be reported directly to the Payment Operator according to the terms of the payment transaction. The Seller does not consider complaints related to payment processes on the Service.

3.     Complaints concerning the provision of Access to the Platform, Access to the Service, functioning of the registration form, and other functionalities of the Service should be reported via email to online@beautyexpert.io with the subject marked as "COMPLAINT."

4.     Complaints will be considered by the Seller promptly, but no later than within 14 days from the day the Seller receives the complaint. The Seller reserves the right that unclear or incorrect identification of the message may extend the period for considering the claims reported.

5.     The response to the complaint will be sent to the Client via email to the email address provided by the Client during the submission of the complaint unless the Client requests a response in traditional form, i.e., in writing to the indicated correspondence address.

6.     For Clients who are not consumers, any warranties are excluded. The Seller does not guarantee the services provided or the timeliness of the content in the training materials provided.

§12. FINAL PROVISIONS

1.     Polish law governs the legal relationships arising from the Client's use of the Service.

2.     The case may be considered by an arbitration court only after the completion of the complaint process and if both parties of the dispute agree to it. Otherwise, any disputes will be subject to the competent courts in accordance with the provisions of the Code of Civil Procedure. The court competent for resolving disputes that may arise from the provision of the Service is the general court competent for the Seller's registered office. This reservation does not apply to consumers.

3.     If some of the provisions of the Terms and Conditions are or become invalid or ineffective, it does not affect the validity and effectiveness of the remaining provisions. Unregulated matters in these Terms and Conditions will follow the applicable legal provisions.

4.     The Seller reserves the right to make changes and modifications to these Terms and Conditions for significant reasons related to the technical or substantive aspects of the Service, particularly in the event of changes in applicable law. Changes will be presented to the Client via email at least 7 days before the new version of the Terms and Conditions takes effect. Changes to the Terms and Conditions do not affect the services previously provided to the Client.

5.     The provisions of the Terms and Conditions are binding at the time of submitting a request for Access to the Platform and, consequently, Access to the Service at least for the first Billing Period. Changes to the Terms and Conditions will be communicated to the Client on the Service's website.

6.     Any changes to the Terms and Conditions become effective upon their posting on the Service's website, unless otherwise stated.

7.     Upon the appearance on the Service's main page or other designated places in the Service of information about changes to these Terms and Conditions and other Regulations, the Client should immediately familiarize themselves with the changes, as using the Service after such an announcement constitutes the Client's unconditional acceptance of the new Terms and Conditions.
